HONOLULU (HawaiiNewsNow) - Judge Karen Ahn is expected to make a decision sometime this week on whether all charges will be dropped against Federal Agent Christopher Deedy.

Prosecutors want to try him for a third time on the lesser charges of manslaughter and assault.

Deedy claimed he shot Kollin Elderts in self defense during a struggle at a Waikiki McDonald's in 2011. He was put on trial twice, once in 2013 -- ending in a hung jury -- and again in 2014 -- where he was acquitted.

The jury, however, deadlocked on lesser offenses of manslaughter and assault. Deputy prosecutor Janice Futa said last year she would recommend Deedy face those charges again.
