Update: MPD moving forward on charges, park ban after racial rant

The 21-year-old man who went on a racist rant that was caught on cell phone video could be banned from all Maui county parks for a year.

Maui Police are also moving forward with Terroristic Threatening and Harassment charges, both misdemeanors.  The case is currently at the prosecutors office being reviewed.

The man, who we are not identifying because he hasn't been arrested, went on a profanity-laced tirade that lasted a minute and thirty-seven seconds last Saturday.

The man is considered homeless and has been arrested and cited several times for disorderly conduct.

It's a racial rant that has been seen by more than a quarter of a million people.

A 21-year old man, with a criminal past, was caught on cell phone video unleashing racial statements against a Kihei couple and their friends at Kalama Beach Park.

According to the man who posted the video on YouTube, it was shocking.  He only wants to be identified as 'John Doe', but says he's the man in the video wearing the blue shirt with long sleeves.  He says his group was eating on a picnic table when a man on another table threw an object at a dog.

'John Doe' says he stood up and said something to that person, "I said, we're dog lovers and that's not really cool," says 'John Doe'.

The man who threw the object did not respond, but another man did … unleashing a racial rant filled with profanity.

'John Doe' says his wife started recording the rant on her cell phone video.   You can see 'John Doe' walking backwards away from the man who is advancing.

The man keeps referring to them as 'Haoles' or 'white people' even saying, "This is Hawaii, we do whatever we (expletive) want out here, abuse dogs, hit women, that's all we do."

The man continues for a total of a minute and thirty seconds before a woman who was with him at the park intervenes.

'John Doe' tells me by phone that he and his wife have lived on Maui for about a year and have never had any problems with locals and have always been treated with 'aloha'.   He says, 99.9% of the comments on the YouTube video are supportive of the couple.

Tommy Aiu – law enforcement expert – says the couple did exactly what they should have, "They tried to distance themselves from the individual," says Aiu, who also thought recording the confrontation was also very smart.

Maui Police responded immediately and 'John Doe' says he turned over the video to them that night.  The case is under investigation and is being forwarded to prosecutors.

Aiu says charges could range from harassment to terroristic threatening and could move forward as a hate crime.

'John Doe' says he doesn't think they will visit Kalama Beach Park again anytime soon.
