Day 3: Jurors shown dramatic images from night of fatal shooting
HONOLULU (HawaiiNewsNow) - For the first time in Christopher Deedy's murder trial the jury was shown surveillance video from inside the McDonald's restaurant on Kuhio Avenue. It was taken between 2:30 a.m. and about 3:00 a.m. on Nov. 5, 2011.
The moving images show the scuffle between Deedy and Kollin Elderts that ended with Elderts being fatally shot.
Deedy's seen ordering food at the counter flanked by two friends, then seated with them in a booth. The video also shows Elderts and his friend Shane Medeiros ordering food at the counter.
At one point Elderts turns his attention toward customer Michel Perrine. Deedy's lawyers said Elderts was hassling Perrine, and Deedy came to his defense.
Honolulu police detective Peter Boyle walked the jury through the video.
The time stamp shows that at about 2:42 a.m. Deedy and Elderts are face to face before a scuffle ensues. Deedy is knocked backward, toppling into a hand sanitizer stand. In the background Medeiros and Deedy's friend Adam Gutowski can be seen grappling.
Elderts turns toward them, then returns to Deedy who's now on his feet. When Elderts advances, Deedy appears to warn him back with his left hand while he reaches for his gun. They grapple and disappear to the left of the screen.
Three shots were fired.
"The projectile that was recovered was recovered from this corner post along the Kuhio Avenue wall," Boyle said, pointing to a diagram of the McDonald's.
The final shot hit Elderts in the chest. He bled to death. Some of his relatives looked down while the video was played.
Deedy is a special agent with the U.S. State Department. He was in Hawaii to provide security for the APEC summit.
Elderts went to McDonald's after partying with friends.
The video shows the scuffle that led to the shots but there is no sound. The prosecutor and defense attorney will have to fill in the blanks through eyewitness testimony.
