HONOLULU (KHNL) - An Oahu woman, who was convicted of beating and torturing five children who lived with her, continues to enjoy her freedom more than a month after receiving her prison sentence.

Instead of ordering Rita Makekau to begin serving her five-year prison term Monday, Circuit Judge Virginia Crandall allowed her to remain free on bail pending her appeal.

Prosecutors say Makekau repeatedly abused the kids, who are now undergoing therapy.

The 52-year-old says state courts have no jurisdiction over her because she's a Native Hawaiian.
