Navy Pleased with Court Ruling

(KHNL) - Navy officials say they are pleased the U.S. 9th Circuit Court of Appeals approved their motion to stay a lower court ruling that would bar the Navy from using active sonar in certain multi-ship exercised off Southern California through January 2009.

The Navy had asked the appeals court to stay a preliminary injunction that was granted by a U.s. district judge on August 6. 

That injunction was granted in a lawsuit filed by the Natural Resources Defense Council and other environmental and animal protection groups, who claim active sonar transmissions harm whales and other marine mammals. 

A two-member majority of a three-judge panel of the appeals court granted the Navy's request Friday.
