Convicted Sex Offender Strikes Deal in Rape of Elderly Woman

HONOLULU (KHNL) -- A man already convicted of sex assault in 1989 pleaded guilty Thursday to raping an elderly woman in Kaimuki last March.

David Baldaino switched from his original plea of not guilty after cutting a deal with prosecutors.

Maneuvering with cuffs on his wrists, Baldaino signed papers to end his court fight. The 37-year-old now admits he broke into an elderly woman's apartment while she was sleeping, and sexually assaulted her at knife-point.

"You understand that once you enter your pleas, it will be very difficult for you to change your mind and ask for a trial later on?" Circuit Judge Richard Perkins asked.

"Yes, sir, I understand that," Baldaino said.

"You sure you want to proceed?" Perkins asked.

"This is the way to go," the defendant responded.

Baldaino also pleaded guilty to three counts of failing to update his information with the sex offender registry.

The convicted sex offender lived right across the street from the 85-year-old victim.

"He knew her and she was very kind to him," Honolulu deputy prosecutor Lori Wada said. "They were neighbors. And clearly, she was mortified at what happened."

The woman did not recognize her attacker. Prosecutors say DNA evidence points to the defendant.

Under a plea deal with prosecutors, Baldaino will be sentenced to 20 years in prison for the sex assault, kidnapping and burglary, and 10 years for the three charges relating to the sex offender registry.

The defendant agrees to serve those terms consecutively.

"You must register. Otherwise, you will be facing this kind of prison term," Wada said.

Defense attorney Debra Loy had no comment after the hearing. Baldaino is scheduled to be sentenced June 7th.
