HONOLULU (HawaiiNewsNow) - The driver in the deadly Kailua boating accident made his first court appearance on Tuesday.
Sai Hansen was the operator of the 24-foot zodiac that struck and killed diver Sri Shim near flat island on January 9.
He was cited for not having a proper boating license when the accident occurred.
Hansen was prepared to respond to the complaint but it was dismissed by the state to make way for a negligent homicide investigation which is being conducted by the city prosecutor.
"My client is extremely sorry about what happened. He has wanted to make gestures to the family, condolences." Hansen's attorney, Howard Luke said
Witnesses say they saw Hansen's boat speeding that day, but Luke says he's skeptical of those accounts.
