Police: DLNR officer sexually assaulted girl after finding her smoking pot

A Big Island state conservation law enforcement officer has been charged with sexually assaulting a minor.

Court documents show Ethan Ferguson, 39, sexually assaulted the 16-year-girl at a beach park in Hilo on New Year's Day.

Ferguson, who was in uniform, found the teen smoking marijuana, and allegedly told her that he wouldn't take her to the police station if she gave him money, drugs or sex.

The girl told him she didn't have money or drugs and wasn't willing to give him sex. That's when Ferguson allegedly sexually assaulted her.

The victim later picked Ferguson out of a line-up.

Ferguson, a Hilo resident, was arrested January 7 and charged with two counts of second-degree assault and three counts of fourth-degree assault.

Ferguson works for DLNR as a conservation and resources enforcement officer. He's held the job since June 2013.

DLNR said Ferguson has been placed on administrative leave with pay, pending an investigation.

The state has 109 Division of Conservation and Resources Enforcement officers statewide, including 27 on Hawaii Island. Officers undergo background checks prior to employment.

DOCARE officers have full police powers to enforce laws and rules involving state lands, parks, historic sites, forest reserves, coastal and marine zones and conservation districts.
