The man accused of shooting and killing a Palolo father of 10 was released Wednesday from police custody.

Police arrested 43-year-old Wilbur Gutierrez just after 7 p.m. Tuesday night on suspicion of second-degree murder and robbery. He was arrested at the police headquarters on South Beretania Street.

Sources say witnesses positively identified him Tuesday night.

Gutierrez is now being held for a parole violation with the Department of Public Safety.

The Liliha man is accused of shooting 45-year-old Rimoni Pologa, while holding up a convenience store Saturday night. The store owner said he believes the gunman got scared because Pologa was blocking the only exit.

Records show Gutierrez has a lengthy criminal history including eight felony convictions. He has been in and out of jail numerous times for multiple drug and weapons crimes.
