Judge denies motions against 3rd trial for Christopher Deedy

HONOLULU (AP) - A judge is denying defense motions that would have prevented a third trial against a federal agent who shot and killed a man in a Hawaii fast-food restaurant.

According to online court records, Judge Karen Ahn denied the motions Friday.

Attorneys representing State Department Special Agent Christopher Deedy argued against a third trial for manslaughter after a jury acquitted him of murder last year. Jurors weren't able to reach a verdict on manslaughter. The first jury deadlocked.

After the second trial, prosecutors said they would seek another one for manslaughter.

Defense attorney Thomas Otake says he'll appeal and is confident appellate courts won't allow another trial.

Deedy says he acted in self-defense when he shot Kollin Elderts inside a Waikiki McDonald's in 2011.

Prosecutors say Deedy was drunk and inexperienced.
