HONOLULU (HawaiiNewsNow) - Honolulu City Council candidate Tommy Waters is challenging the results of the general election.

Waters lost to Trevor Ozawa by 41 votes.

Waters filed the challenge just before the deadline Monday in the Hawaii Supreme Court.

He claims there are 11 more ballots than people signed in for at some polling places. And he says at other locations, there are 39 missing or unaccounted ballots.

"It's so close," says Waters, "The election was decided by one tenth of one percent."

He also wants more than 4400 blank ballots checked again to make sure they weren't misread.

"Could have been circled rather than filled in, a check mark, a slash mark or something like that," Waters says.

Councilman-elect Trevor Ozawa is supposed to take office just after the new year. He believes the challenge is a waste of resources for the people of District 4.

"I believe in the system," says Ozawa, "I believe in races this close, they definitely double and triple checked. They have their own internal audit systems which I completely have faith in. "
