Trial date reset for 2 ex-Vandy football players accused of rape

The trial for two of the four former Vanderbilt football players accused of raping an unconscious woman inside a university dorm room has been delayed.

At a court hearing on Friday, the defense attorneys for the suspects argued that their cases were not ready, and Judge Monte Watkins rescheduled the trial to begin on Nov. 3 for Brandon Vandenburg and Corey Batey.

The trial for Vandenburg and Batey was set to begin on Aug. 11.

Batey, Vandenburg, Brandon Banks and Jaborian McKenzie are all accused of raping an unconscious student in a Vanderbilt dorm room last summer.

Vandenburg is also accused of taking video and pictures of the alleged attack and sending them to his friends.

Batey was in court on Friday, but Vandenburg listened to Friday afternoon's hearing by phone from California.

Vandenburg and Batey will be tried together in November. Defense attorneys say Banks and McKenzie will likely be offered a deal in exchange for their testimony against Batey and Vandenburg.

"They're not set for trial, and that is often a precursor to an agreement," said Vandenburg's attorney, John Herbison.

"They've been separated out of this case, and yes, absolutely, I think they will be getting some type of deal, we'll call it that. I think that absolutely they will testify against Mr. Batey and Mr. Vandenburg," said Batey's attorney, Worrick Robinson.

The victim's medical records were also discussed in court on Friday. Her attorney is fighting to keep those records private except for records that are relevant to the case. The judge said he agrees with that but will issue his final order on the matter next week.
