HONOLULU (HawaiiNewsNow) - A lawsuit was filed Monday on behalf of the estate of Kathleen Kern, one of the victim's in the deadly plane crash on Lana'i on February 26.
Heather Shannon, Kern's sister, is the plaintiff. Maui Air, Maui Aircraft Leasing LLC and the estate of Richard Rooney, the pilot of the aircraft who also died in the accident, are the defendants.
The lawsuit claims it was pilot error that caused the crash. It seeks unspecified damages for Kern's estate.
"The NTSB is going to go into checking the engines, looking at the maintenance records. All I can say is this particular aircraft, from experts I've spoken to, is not one that has had a lot of major problems in the past" said Rick Fried, attorney for the plaintiff.
Results from the National Transportation Safety Board's investigation are still pending.
Kern, Rooney and Tremaine Balberdi all died in the crash. Three other passengers, James Giroux, Doug Miller and Mark King survived.
