Paroling authority to determine prison time for freeway shooter

Maile Nguyen, the eldest daughter of the late Tammy Nguyen, was the only family member of the victim to be present for the parole hearing of convicted killer Toby Stangel Thursday.

She kept her comments brief. They were, however, impactful.

"Just imagine you were in our shoes, and if this happened to you, would you want somebody like this out?" she asked the parole board. "Every day I suffer from insomnia, I can't sleep. Not only me, imagine what my sister has to go through" she continued. Nguyen was referencing her sister who was in their mother's car on June 3, 2011. That's the date when Stangel went on a drug fueled rampage. He got out of his car at a Kaimuki intersection and shot her to death. He also wounded two other people.

"When this offense occured, he was taking drugs. He didn't try to seek help for it at that time" said Deputy Prosecuting Attorney Dwight Nadamoto during the hearing. He asked that Stangel serve 50 years for each of the consecutive life sentences before the possibility of parole, amounting to a 150 year sentence.

"We basically believe he's a danger to society, and you look at the circumstances of this case we don't believe he should get out of prison frankly" he said afterwards.

Stangel's attorney, John Schum, disagreed. He asked the board that Stangel serve a total of twenty years before the possibility of parole.

"He wrote apology letters to all the families involved, he spoke in court, he has expressed great sorrow for what has happened" noted Schum.

Stangel, who appeared via videoconference from incarceration in Arizona, said he was a changed man.

"I just try to better my life in here, and encourage other people to do good" he said.

The board will issue a decision in approximately two weeks.
