Kauai sex offender sentenced to ten years in prison

Justin K. Espinueva, age 30 of Hanamaulu, was sentenced Tuesday to 10 years in prison for a pair of sexual assault cases dating back to 2006 and 2007.

Circuit Court Judge Kathleen N.A. Watanabe handed down the sentence after revoking Espinueva's probation on seven counts of Sexual Assault in the Second Degree.

Espinueva was initially put on probation in 2009, and then re-sentenced to probation again in 2010 after violating the terms and conditions of the 2009 sentence.

Deputy Prosecuting Attorney Lisa Arin argued that Espinueva is a sex offender who is a danger to the community and who lied to his probation officer and to his treatment provider, and continued to violate the boundaries put in place to ensure that he does not reoffend. In addition to his lies, he was residing in a home with minor children and viewing pornography.

Prosecuting Attorney Justin F. Kollar stated, "Enough is enough. This defendant has proven, repeatedly, to the Court and to the community that he cannot be successful on probation. He stands convicted of serious crimes and the only option that will keep the community safe from this defendant is to place him in prison."
