LIHUE, KAUAI (HawaiiNewsNow) - Following a three-day jury trial before the Honorable Chief Judge Randal G. B. Valenciano, a fifth circuit jury took less than two hours to find Samuel Charles McFadden, age 63, formerly of 'Anini, guilty as charged of Sexual Assault in the Second Degree, a class B felony.
The State of Hawaii was represented at trial by Deputy Prosecuting Attorney Lisa Arin and the defendant was represented by Deputy Public Defender Sam Jajich. KPD Detective Kekoa Ledesma and Officer Chito Garduque conducted the investigation.
In this case, the 26-year-old victim was on vacation from the mainland with her friends, and met the defendant while camping at 'Anini Beach in August of this year. McFadden presented himself as an experienced energy healer and sexually assaulted the victim while providing his services.
Police arrested McFadden later that day.
Prosecuting Attorney Justin F. Kollar thanked the investigators and the staff of OPA's Victim/Witness Program for their help in bringing McFadden to justice: "These types of cases can present many difficulties at trial, and the safety and well-being of the victims are first and foremost in our efforts. Our Counselors, Deputy Prosecutors, and Detectives have the skills needed to obtain justice for these victims and ensure that our community is kept safe from sexual predators."
Sentencing is set for April 3, 2014. McFadden is currently being held at Kauai Community Correctional Center.
