Hearing on new trial for federal agent delayed

HONOLULU (AP) - A court spokeswoman says a hearing has been delayed two weeks to schedule a new court date for a federal agent accused of murdering a man during a scuffle in McDonald's restaurant in Waikiki.

Spokewoman Marsha Kitagawa of the state judiciary said Wednesday the new scheduling hearing in the case of State Department Special Agent Christopher Deedy is set for Sept. 13.

Deedy, accused of killing 23-year-old Kollin Elderts, is not expected to attend. The 29-year-old Deedy is returning home to Arlington, Va., but will return for his retrial.

Judge Karen Ahn declared a mistrial Monday after the jurors said they could not unanimously decide on a verdict, and that more time wouldn't allow them to resolve their differences.
