Day 18: Deedy takes stand; says Elderts was the aggressor

HONOLULU (HawaiiNewsNow) -

Jurors listened intently as federal agent Christopher Deedy took the stand in his murder trial on Tuesday. He told them he stepped in to prevent more problems, but the situation quickly escalated.

After describing his law enforcement background, Deedy said he intervened after seeing Kollin Elderts and a friend harassing a customer in a Waikiki McDonald's in November 2011.

"He said something like, 'Hey, f****** haole, hey f****** haole, you like beef, too?'" recalled Deedy.

Deedy testified that Elderts appeared to be drunk, and that he displayed hostile, aggressive behavior.

"After I said, 'Nobody here wants to fight,' his immediate response was, 'I'll f*** you up,'" said Deedy.

"What did that mean to you?" questioned defense attorney Brook Hart.

"I will hurt you," replied Deedy.

As the dispute escalated, the agent said he showed them his state department credentials and identified himself as a law enforcement officer.

"He said, 'You won't arrest me. You got a gun? You gonna shoot me?'" recalled Deedy.

"And what was your response to that? How did you feel when you heard that?" asked Hart.

"That was not what I expected," answered Deedy.

When asked why he didn't just leave, Deedy pointed to his law enforcement training.

"For me, seeing a volatile individual, as a law enforcement officer, to simply walk away from something that I had taken responsibility for at this point would be totally irresponsible," said Deedy.

He told the jurors that he reached for his gun after seeing Elderts pat his waistband a couple of times.

"As he came forward, what did you do?" asked Hart.

"He came very quickly and I employed a front kick," answered Deedy.

While on the stand, Deedy also disputed the prosecutor's argument that he was drunk that night.  He said he did party with friends, and he drank four beers over a number of hours, which is the limit he always sets for himself. 

The defense insists Elderts attacked Deedy who shot him in self defense.  Prosecutor Janice Futa maintains Deedy was drunk and instigated the confrontation.

Testimony wrapped for the day before Christopher Deedy was able to describe the moment when the fatal shooting occurred. 

He will take the witness stand again at 9 a.m. Wednesday.
