Day 17: Security guard says Elderts was unruly

Rosalinda Soriano said when the situation between Christopher Deedy and Kollin Elderts appeared to be getting out of hand she called 911. But things happened fast.

"I hear something like gunshots," she said.

Soriano was the security guard in the McDonald's restaurant on Kuhio Avenue during the early morning hours of Nov. 5, 2011. She said Elderts was loud and drunk and repeatedly harassed and bullied customer Michel Perrine.

"He was staggering. He was leaning on the counter. He was disturbing customer," she said.

Soriano had an interpreter by her side but rarely used her to translate from Filipino into English. She said before the verbal confrontation turned physical Deedy was under control.

"Mr. Deedy was talking to Mr. Elderts, looks like a concerned guy," she said.

Soriano testified for the defense in Deedy's murder trial. The federal agent shot Elderts during a scuffle. He said he acted in self defense.

Soriano described the incident as a rumble. She said before the struggle Elderts was the aggressor.

"Who started the rumble?" defense attorney Brook Hart asked.

"It's not Mr. Deedy," she answered.

But she admitted her attention was split between calling police dispatch and the chaos of the moment, so she missed key points in the confrontation.

"It happened so fast so I didn't see who hit first," she told prosecutor Janice Futa.

Soriano also said she didn't see who fired the shots, but she did see Elderts on the floor.

"Mr. Deedy was trying to revive Mr. Elderts," she said.

She said Deedy didn't appear intoxicated that night.  The prosecutor insists the federal agent was drunk and triggered the altercation by threatening to shoot Elderts.
