Day 15: Deedy friend says he identified himself to Elderts

HONOLULU (HawaiiNewsNow) -

Jessica West said her friend Christopher Deedy seemed normal and calm as they partied before going to McDonald's on Kuhio Avenue. She said he had been drinking some beer but wasn't drunk when they arrived at the fast food restaurant on November 5, 2011.

"Was there anything about Chris that suggested that he was under the influence of alcohol from your perspective?" defense attorney Brook Hart asked.

"I don't believe so," West answered.

Hart walked West through McDonald's surveillance video. She said she saw Kollin Elderts and Shane Medeiros at the counter, and remembers that Deedy was watching them.

"We were engaged in conversation up until the point where he seemed to have his attention drawn to the front of the restaurant. Then he was a bit distant. His attention was elsewhere," she said.

The defense maintains Deedy, a State Department special agent, was concerned Elderts was harassing customer Michel Perrine, calling him "haole."

Earlier in the trial Perrine told prosecutor Janice Futa that he never felt threatened and Deedy never asked him if he needed help.

West said she and her boyfriend Adam Gutowski walked out of McDonalds. She returned when she noticed Deedy didn't follow them. She said she saw him at Elderts' table.

"I saw Chris pull out what looked to be a wallet from his back pocket, flip it open and present it face forward to Kollin," she said.

She said Elderts got angry.

"He had a scowl on his face. He was talking at Chris and he was doing it in a way that was consistent with being mad, angry, he wasn't happy," she said.

West said Elderts got up and walked toward Deedy in a "challenging manner."

"The only way I can describe it is puffing himself up, making himself big," she said.

Elderts was fatally shot in the chest during a scuffle. Deedy claims self defense.

West was the first defense witness to testify in Deedy's murder trial. She said she heard the shots but didn't see the shooting because she and Gutowski were involved in a scuffle with Medeiros.
