HONOLULU (AP) - A federal appeals court ruling allows a Kauai bus driver to proceed with her gender discrimination lawsuit against the county.
The 9th U.S. Circuit Court of Appeals this week ruled Kathleen Ah Quin's lawsuit against the Kauai Department of Transportation must return to district court. The ruling says the lower court was wrong to throw out the case after she didn't close the discrimination lawsuit when she filed for bankruptcy protection.
Her lawsuit against the county claims her work hours were reduced and she was denied full-time status because of her gender. She was required to disclose the lawsuit as an asset when she filed for bankruptcy, because if she prevailed, she could have won money that would have covered her debts.
A dissenting judge says the omission was deceitful.
