Day 10: Deedy's friend said he was severely beaten

Adam Gutowski told the jury in Christopher Deedy's murder trial that Deedy seemed sober while they were bar-hopping before they went to the McDonald's on Kuhio Avenue.

"Is there anything about him that suggested to you that Chris was under the influence of alcohol at that point?" defense attorney Brook Hart asked.

"No. His behavior didn't indicate that in any way to me," Gutowski said.

Prosecutors believe Deedy was intoxicated when he got into a fatal scuffle with Kollin Elderts on Nov. 5, 2011. Deedy, a federal agent, claims he shot Elderts in self-defense.

Gutowski said he tried to calm the situation before it became physical.  But deputy prosecutor Janice Futa asked him why he didn't do more.

"Did you ever tell your friend Chris to walk away to tone down the tension?" she asked.

"I did not. I was hoping or confident that they would be able to handle the situation themselves," Gutowski testified.

Jurors were shown surveillance video that shows Gutowski and Elderts and his friend Shane Medeiros involved in a physical confrontation just moments before Elderts and Deedy scuffled.

"At that point I don't know exactly how they're beating me, they're just beating me," Gutowski said.

He said he remembers Elderts telling Deedy either, "You have a gun?" or "You're not the only one with a gun."

Futa questioned why he didn't say that to police or the grand jury.  He said he was suffering from a head injury and needed time to process the events.

Hart asked Gutowski about a text message from Deedy before they got together that night.  It  talked about dinner then craziness.

"That's just a general statement of saying meeting up and being excited to see each other for the first time in a little while, at least over a year.  Nothing harmful about that," Gutowski said.

Gutowski and Deedy were roommates at Tulane University.

Deedy is charged with second-degree murder.
