Concerns about nudity, sex acts at beach in Mokuleia

MOKULEIA (HawaiiNewsNow) - Some people are bothered by more than just the nudity at a beach in Mokuleia. One resident voiced complaints about explicit sexual activity to the North Shore Neighborhood Board.

Siri Masterson works as a barn manager and horseback riding instructor at a business near Polo Beach at Makaleha Beach Park.

"I have children who come out to ride and spend time with the horses, and I have to apologize to their parents because this is going on," said Masterson.

A posted sign indicates that nudity is prohibited, but Masterson has filmed several naked sunbathers. According to her, the nudity is creating a problem with explicit sexual behavior.

"A lot of homosexual intercourse, but there is heterosexual intercourse. There are threesomes. There is S&M happening," Masterson said.

The Waialua resident brought her concerns to the North Shore Neighborhood Board on Tuesday night. Masterson said she has called police several times over the last few years, but hasn't had any luck.

"Because of the way the law is written, it's very hard to prosecute anybody, either for being nude or performing these sexual acts," she said.

Under the law, "a person commits the offense of indecent exposure if the person intentionally exposes the person's genitals to a person to whom the person is not married under circumstances in which the actor's conduct is likely to cause affront."

In 2000, the Hawaii State Supreme Court overturned the convictions of four men who were naked at Makaleha.

Masterson hopes that public pressure leads to changes.

"I want everybody to take responsibility for this. It's a community problem. It's not just my problem," she said.
