Judge rules Kauai mayor has authority to suspend police chief

LIHUE, KAUAI (HawaiiNewsNow) -

A Kauai court has decided who has the power to suspend the chief of police.

The Kauai County Police Commission filed a lawsuit in June against Kauai County Mayor Bernard Carvalho, Jr. asking the court to give the police commission authority to suspend or discipline the chief of police.

On Tuesday, Circuit Court Judge Randal Valenciano ruled on the mayor's authority to suspend the police chief.

Citing the Kauai County Charter, Article VII, Section 7.05 relating to the mayor's powers, duties and functions, Judge Valenciano ruled that the mayor, as chief executive officer of the County of Kauai, does have the power to: except as otherwise provided, exercise direct supervision over all departments.

"We are pleased that the court has confirmed our position and now look forward to moving beyond this to focus on the many important matters that face the County," said Mayor Bernard Carvalho, Jr.

The lawsuit was filed 5 months after Mayor Bernard Carvalho suspended Chief Darryl Perry over his handling of an employee investigation.
