Agent continues to seek federal court in HI murder

HONOLULU (AP) - The lawyer for the federal agent charged in a shooting death in a Waikiki McDonald's says the case should move from state to federal court even though a 30-day window to request the change has passed.

State Department Special Agent Christopher Deedy is charged with murder in the November shooting of a Hawaii man. Defense attorney Brook Hart filed a response this week to a Honolulu prosecutor's objections to moving the case to federal court because too much time has passed.

Hart claims prosecutors didn't provide discovery until after the 30 days. He also cites delays from the federal government.

Hart says federal court would be in a better position to move the case to another federal district if Deedy can't get a fair and impartial jury in Honolulu.
