Man pleads no contest to breaking into home that was being fumigated

HONOLULU (HawaiiNewsNow) - A man who was overcome by toxic gases after breaking into a tented home that was being fumigated pleaded no contest to first-degree burglary Tuesday.

James Malgana, 22, faces up to 10 years in prison when he is sentenced March 14th. His attorney is considering asking for a deferral.

Police say Malgana and co-defendant Joshua Yoshimura started removing items from the home on Lusitana Street last July, when they were overcome by the fumes. Both were taken to the hospital for treatment.

Yoshimura pleaded guilty last October and is awaiting sentencing.
