Man charged with kidnapping child found mentally fit to stand trial

HONOLULU (HawaiiNewsNow) - An Oahu judge on Thursday ruled that a man accused of kidnapping a five-year-old girl in Waipahu last April is mentally fit to stand trial.

Circuit Judge Richard Perkins made that ruling after a panel of three mental health experts examined Anthony Davis, 22, and determined that he understands the proceedings against him and can assist in his defense. However, prosecutors say the doctors also decided that the defendant shouldn't be held criminally responsible for the incident because he was mentally impaired at the time.

Investigators say Davis grabbed the child near the swimming pool at Waipahu District Park, but a lifeguard saw what happened, caught the suspect and held him until police arrived.

The defendant reportedly suffers from bipolar disorder. But prosecutors plan to fight the insanity defense at trial, saying that Davis was also a drug user.

Davis is locked up at the Oahu Community Correctional Center, unable to post $100,000 bail.
