Charges dismissed in World Botanical Gardens case

HONOLULU (AP) - Financial fraud charges against the former president of a Big Island tourist attraction called World Botanical Gardens have been dismissed.

Pepeekeo residents Walter L. Wagner and his wife, Linda M. Wagner, were indicted in 2008 on charges that they allegedly used deception to gain control of property worth more than $20,000 belonging to World Botanical Gardens.

Deputy Prosecutor Jason Skier said the case was dismissed last month without prejudice due to a technicality.

The Wagners could be recharged.

World Botanical Gardens, located north of Hilo, features waterfalls, ocean outlooks and trails.
