Man who caused permanent brain injuries in baby daughter gets life sentence

HONOLULU (HawaiiNewsNow) - Calling his conduct "inexcusable," an Oahu judge on Thursday sentenced a man to life in prison for inflicting permanent brain damage on his baby by throwing her around during an argument with his girlfriend in 2007.

Pulumataala Eli will serve a mandatory minimum term of six years and eight months because of his status as a repeat offender and because of the age of his victim.

A jury last year found him guilty of attempted manslaughter. At trial, Sarah Fuller testified that she and her boyfriend, Eli, were in their van at Ala Moana Beach Park, when he became irritated and started blaming their seven-month-old daughter, Alice, for the problems in their relationship.

Prosecutors say Alice, who will turn three years old next month, will not recover from the brain injuries she suffered when her father tossed her around the van, "treating her like a rag doll."

The child is now in foster care.

At sentencing, Eli apologized for his actions, saying he knows he failed as a father.

Circuit Judge Randal Lee also revoked Eli's probation for an earlier first-degree assault, in which he shot a man, and re-sentenced him to 10 years in prison. Lee says the public needs to be protected from his "flagrant and dangerous behavior."
