HONOLULU (HawaiiNewsNow) - Prosecutors on Thursday went before an Oahu grand jury and secured a more serious charge against the man accused of killing a woman while driving drunk at the Nanakuli McDonald's.

Prosecutors say Albert Birmingham's blood alcohol level was 0.132 at the time of his arrest. That's well over the legal limit of 0.08.

The grand jury indicted the 36-year-old on a manslaughter charge, instead of the lesser offense of negligent homicide. Manslaughter is a felony punishable by up to 20 years in prison.

Investigators say Birmingham drove his SUV into two people, as he fled from a dispute with another driver in the restaurant's drive-thru. Raelynn Adams, 20, died from her injuries.

The suspect is also charged with failure to render aid, consuming liquor while driving, and driving with a revoked license.
