Judge refuses to disqualify himself from suspected child killer's case

HONOLULU (HawaiiNewsNow) - An Oahu man accused of tossing a toddler off a freeway overpass will finally stand trial, two years after the little boy's death.

Attorneys will go ahead with opening statements in the non-jury trial next Monday, after a judge refused to remove himself from the case Wednesday.

Defense lawyer Randy Oyama had accused Circuit Judge Dexter Del Rosario of having a personal bias against him and said his client, murder suspect Matthew Higa, couldn't get a fair trial.

Witnesses say Higa threw 23-month-old Cyrus Belt from a pedestrian walkway onto the H-1 Freeway below. The defense plans to argue that the boy was already dead when Higa dropped him.
